1. APPLICATION

1.1 These Terms & Conditions govern the provision of Seymour Chauffeur Limited services to its Customers and the nature of the relationship between Seymour Chauffeurs Limited and its Customers.

1.2 Notwithstanding any other agreements, policies or related documents which these Terms & Conditions reference, Seymour Chauffeurs Limited and its Customers agree these Terms & Conditions represent the totality of the relationship between Seymour Chauffeurs Limited and its Customers.

1.3 We ensure compliance with the Private Hire Vehicles (London) Act 1998, meaning the operator is responsible for accepting bookings and providing transportation services

1.4 The Terms & Conditions herein supersede all previous terms and constitute a legally binding agreement between Seymour Chauffeurs Limited and its Customers.

1.5 The contract for all bookings is between the customer/passenger (i.e., the company or individual booking and paying for the transportation service) and Seymour Chauffeurs Ltd. Seymour Chauffeurs is responsible for both accepting bookings and providing transportation services.

2. NATURE OF RELATIONSHIP – PRIVATE HIRE BOOKING SERVICE(S)

2.1 The Company is an incorporated company carrying on an independent business as a Private Hire Operator inviting, and accepting, Private Hire Booking(s).

2.2 The Customer is a person making a Private Hire Booking with the Company for Transportation Services.

2.3 The Company is principal for the purposes of Regulation 9(14) Private Hire Vehicles (London) (Operators’ Licences) Regulations 2000 (as amended).

3. COMPANY OBLIGATIONS – PRIVATE HIRE BOOKING SERVICE(S)

3.1 Seymour Chauffeurs, as a licensed Private Hire Operator, will invite and accept Private Hire Bookings in line with TFL Private Hire Licensing Law.

3.2 Seymour Chauffeurs shall notify the Customer of its acceptance of a Private Hire Booking in accordance with TFL Private Hire Licensing Law.

3.3 When Seymour Chauffeurs accepts a Private Hire Booking from a Customer, it will hire a Private Hire Vehicle Driver(s) and a Private Hire Vehicle(s) to provide the Transportation Service.

3.4 Seymour Chauffeurs shall have the discretion to select how the Private Hire Booking and Transportation Service(s) will be carried out.

3.5 Seymour Chauffeurs reserves the right, pursuant to Private Hire Licensing Law (including, but not limited to, the Equality Act 2010 (as amended)), to decline a Private Hire Booking request or withdraw.

4. CUSTOMER OBLIGATIONS – PRIVATE HIRE BOOKING SERVICE(S)

4.1 Seymour Chauffeurs is responsible for both accepting the booking as well as the provision of the journey.

4.2 A contract is created between the operator and the passenger for the booking as well as the provision of the transportation services.

4.3 Fares for the journey is either collected by the operator or collected by the driver on behalf of the operator, including arrangements where the driver acts as the agent for the operator in collecting fares; Only the operator can cancel a booking with a passenger, (although the driver may reject an offer from the operator to carry out a particular journey); and liability in relation to the transportation services belongs to the operator.

4.4 We reserve the right to substitute any vehicle or chauffeur/driver.

4.5 Nothing contained in these terms and conditions affects the Client’s’ statutory rights.

4.6 The Customer shall ensure all information provided to the Company for a Private Hire Booking is accurate and correct.

4.7 The Customer shall pay to the Company any Additional Charge(s), however incurred, at a reasonable rate determined by the Company from time to time, for the following:

4.7.1 Airport parking fees incurred during the Transportation Service(s).

4.7.2 Cancellation of a Private Hire Booking by the Customer following the commencement of the Transportation Service.
4.7.3 Congestion Charge or Ultra Low Emission Zone (ULEZ) levy expenses incurred while providing transport services.

4.7.4 Surcharge(s) in relation to the following

4.7.4.1 Private Hire Booking(s) and Transportation Service(s) that need travel from or to an airport or railway station.

4.7.4.2 Private Hire Booking(s) and Transportation Service(s) that need transit outside of London.

4.7.4.3 Private Hire Booking(s) and Transportation Service(s) that need travel on Good Friday, Christmas Day or other bank holidays (under the Banking & Financial Dealings Act 1971 (as modified)).

4.7.4.4 Private Hire Booking(s) and Transportation Service(s) that need transit outside of regular business hours.

4.7.4.5 Booking(s) for private hire and transport services that need transit during peak demand periods.

4.7.4.6 Private Hire Booking(s) and Transportation Service(s) that require specified vehicle types.

4.7.5 Changes to Private Hire Booking(s) and Transportation Service(s) from those accepted in the original Private Hire Booking at the Customer’s request.

4.7.6 Waiting time caused by the Customer’s activities or omissions during the performance of the Transportation Service.

5 Cancellation Policy

5.1 If a booking is cancelled within 1 hour of the requested pick-up time we reserve the right to make full charge for the journey. If, however the pick-up location necessitates the car being dispatched more than an hour before the pick-up time we again reserve the right to make full charge for the journey.

5.2 If the passenger does not appear and make contact with our driver at the booked time and the designated pick-up point, we reserve the right to make full charge for the journey.

5.3 Our bookings cancellation policy reflects the availability of the vehicles in our fleet.

5.4 Upon acceptance of your booking we reserve the availability of the vehicle for you and subsequently refuse all other bookings for that vehicle at that time and on that date.

6 Insurance

6.1 The Company will maintain all essential insurance coverage for the operation of its business, including but not limited to Private Hire Licensing Law.

6.2 The Customer takes entire responsibility for providing sufficient insurance coverage during the Company’s transit of any of the Customer’s products or items.

7 Data Protection

7.1 The Company will comply with all applicable provisions of the General Data Protection Regulation (GDPR) (EU) 2016/679 (as incorporated by the Data Protection Act 2018).

7.2 The Company shall provide the Customer with a copy of its Privacy Policy in accordance with Article 12 of the General Data Protection Regulation (GDPR) (EU) 2016/679.

7.3 The company is registered with the Information Commissioner’s Office (registration number ZB741661).

 

 

 

Various Terms

While we make every effort to ensure that our drivers arrive on time, please realise that we cannot assume responsibility for delays caused by circumstances beyond our control.

The driver will maintain safe and reasonable speeds in compliance with road conditions, traffic, and legal speed limits.

Customers are responsible for any damage they cause to the interior and/or exterior of a vehicle on hire, and will be billed accordingly for any repair or valeting required to restore a vehicle to working order, as well as any subsequent loss of business for the driver as a result of their vehicle being out of service.

We may subcontract bookings to another private hire operator.

We reserve the right to replace your vehicle or chauffeur at any moment if necessary.

Seymour Chauffeurs Ltd will make every effort to ensure that our or subcontractors’ vehicles arrive on schedule. It is the Customer’s obligation to ensure that adequate time is allotted for the completion of the Service. Seymour Chauffeurs provides journey time advice in good faith, but does not guarantee that any journey will be completed in a specific time and is not liable for any direct or consequential loss, delay, or inconvenience caused to the Passenger(s) by the actual journey time.

Our Chauffeurs will take the most appropriate route on the day unless requested otherwise by the Client at the time of booking.

Seymour Chauffeur vehicle(s) and sub-contracted vehicles are fully insured against passenger and third-party claims. However, customers’ properties are transported fully at their own risk, and Seymour Chauffeurs Ltd shall not be held liable for any loss or damage to such property.

The passenger is responsible for their bags and personal things at all times and must ensure that they are loaded into the vehicle prior to the start of the service and unloaded from the car at the end of the service. Seymour Chauffeurs accepts no responsibility for any loss or damage to luggage and personal items, or consequential losses, coming as a result of luggage and personal goods that are not loaded or unloaded from the passenger car.

Seymour Chauffeurs will retain a lost property book at their headquarters at 171 Seymour Place, London W1H 4AT, and will make every effort to return any lost goods left in our or subcontractors’ vehicles to the customer.

Seymour Chauffeurs and its chauffeurs reserve the right to refuse to transport any passenger who is suspected of being under the influence of alcohol or drugs and whose behaviour endangers the chauffeur, the vehicle, or any other passenger(s).

Seymour Chauffeurs maintains a strict non-smoking policy in all its vehicles.

Booking Services

Seymour Chauffeurs is a TfL-licensed private hire vehicle operator. As a result, we only accept booking requests for chauffeur-driven transportation directly from our customers/passengers. We will give a ‘Booking Confirmation’ in accordance with Regulation 9(10) of the Private Hire Vehicles (London) (Operators’ Licences) Regulations 2000 (as amended). Complaints

Speak to us

If a consumer has any problems about Seymour Chauffeurs, they should notify Seymour Chauffeurs as soon as possible, but no later than 7 days following the booking.

Seymour Chauffeurs will always endeavour to find an acceptable solution to any complaint and may provide a refund or account credit after each matter has been thoroughly investigated.
